1. Introduction

Welcome to Fonedash (Pty) Ltd (“Fonedash”, “we”, “our”, or “us”).
By using, purchasing from, or interacting with our services — whether through our website https://fonedash.com, our official WhatsApp line (+27 73 696 5355), in-store locations, or any digital platform — you agree to be bound by these Terms and Conditions (“Terms”).

Fonedash (Pty) Ltd is a registered South African company specializing in smartphones, laptops, tablets, accessories, and related technology products.
We sell new, certified pre-owned, and refurbished devices, as well as provide trade-in, warranty, and after-sales support services.

These Terms govern all sales, orders, and transactions between Fonedash and its customers and are legally binding under the Consumer Protection Act (CPA), Protection of Personal Information Act (POPIA), and the Electronic Communications and Transactions Act (ECTA).

If you do not agree to these Terms, please refrain from using our services or website.


2. Definitions

  • “Customer” or “you” means any individual or entity purchasing from or engaging with Fonedash.

  • “Website” means https://fonedash.com.

  • “Products” means all goods sold by Fonedash, including smartphones, accessories, and electronics.

  • “Business Day” means any day excluding Saturdays, Sundays, and public holidays in South Africa.

  • “Third-Party Providers” means external partners providing payment, courier, or finance services, including Payfast, Yoco, Payflex, Mobicred, Laybuy, MoreTyme, Mukuru, and PayPal.


3. Product Information and Availability

Fonedash strives to ensure that all product descriptions, prices, and specifications displayed on our website are accurate and current.
However, we cannot guarantee the absence of typographical or system errors. In such cases, we reserve the right to correct pricing or product information without prior notice.

All products are subject to availability.
Stock levels are updated frequently, but due to high demand, some items may sell out before an order is processed. In such cases, customers will be notified and offered an alternative or a full refund.

4. Ordering and Payments

Payment must be made in full before orders are dispatched. We accept the following secure payment methods:

4.1 Payfast

Fonedash uses Payfast, a PCI-DSS Level 1 certified payment gateway, to securely process credit, debit, and instant EFT transactions.
Customer information is transmitted over a secure, encrypted SSL connection and Fonedash does not store any banking or card details.
All transactions are processed in South African Rands (ZAR).

4.2 Yoco

Payments made via Yoco (in-store or via online link) are processed securely and encrypted end-to-end.
Fonedash receives payment confirmation only once funds are verified by Yoco’s system.

4.3 Instant EFT & Bank Transfer

Customers may make manual EFT payments directly to Fonedash’s verified bank account. Proof of payment must be sent to our support team for order verification before processing.

4.4 Payflex

Payflex allows customers to buy now and pay over four interest-free installments.
All credit approvals, payment schedules, and defaults are handled by Payflex directly under their credit policy.
Fonedash is not liable for any declined applications or additional charges from Payflex.

4.5 Mobicred

Mobicred offers a revolving credit facility enabling customers to pay over flexible monthly installments.
Credit is approved based on the customer’s financial profile, and Mobicred’s terms apply.
Fonedash merely facilitates integration for convenience and bears no liability for credit rejections or interest disputes.

4.6 MoreTyme

MoreTyme (by TymeBank) allows payment in three interest-free installments.
Customers must have an active TymeBank account and credit eligibility.
Fonedash is not responsible for approval, billing errors, or missed installment penalties.

4.7 Laybuy

Laybuy provides a lay-by payment option allowing customers to reserve products and complete payment over time.
Orders will be dispatched only upon full payment. Laybuy cancellations may incur an admin fee as per policy.

4.8 Mukuru & Airtel Money

Customers may pay via Mukuru or Airtel Money for cross-border or regional purchases.
Transaction limits, fees, and currency conversions are subject to the provider’s policies.

4.9 PayPal

PayPal allows international buyers to purchase securely using their verified accounts.
Currency conversions and fees are determined by PayPal.
Fonedash will only ship to PayPal-verified addresses.

All payments are final once confirmed. Fraudulent activity or suspicious transactions will be reported to the South African Fraud Prevention Service (SAFPS).


5. Delivery & Shipping

Fonedash delivers nationwide and internationally using trusted third-party courier partners (e.g., The Courier Guy, DHL, Aramex).
We do not operate our own courier fleet.

Estimated delivery times:

  • Local: 1–3 business days

  • Regional: 3–5 business days

  • International: 5–10 business days

Delays may occur due to customs, public holidays, or courier logistics.

Ownership and risk transfer to the customer once the parcel is collected by the courier.
Customers are encouraged to add shipping insurance during checkout to protect their order against loss or damage in transit.

Fonedash cannot be held responsible for courier delays, theft, or damage once goods leave our warehouse.


6. Returns, Exchanges & Refunds

Customers have 6 days from the date of delivery to report any faulty or incorrect items for an exchange.
After 6 days, products are covered under our 1-year limited warranty (see Section 7).

Returns are only accepted for defective or incorrectly supplied products — not for “change of mind” purchases.

To request a return, customers must contact support@fonedash.com or WhatsApp +27 73 696 5355 with:

  • Order number

  • Photos of the product and packaging

  • Description of the issue

Returned items must be:

  • In original packaging

  • With all included accessories

  • Accompanied by proof of purchase

Refunds (if approved) will be processed within 7–10 business days.
Shipping costs are non-refundable unless due to a Fonedash error.


7. Warranty & Repairs

All new devices include a 1-year limited warranty covering manufacturer defects.
All refurbished and pre-owned devices include a 6-month warranty.

Warranty does not cover:

  • Accidental or liquid damage

  • Unauthorized repairs or modifications

  • Software issues not caused by hardware defects

  • Normal wear or battery degradation

Warranty claims are assessed by our technical team and may involve diagnostic evaluation or supplier return.
Turnaround time may vary depending on supplier location and parts availability.


8. Trade-Ins & Pre-Owned Devices

Fonedash offers trade-ins subject to inspection and valuation.
Trade-in devices must:

  • Be free from activation locks (Find My iPhone, Google Lock, etc.)

  • Power on and function normally

  • Match the declared condition

Once approved, trade-in values are credited toward a purchase or paid via EFT.
All pre-owned devices are cleaned, tested, and verified with genuine components before resale.


9. Financing & Lay-by

Fonedash provides flexible payment support through:

  • Mobicred, Payflex, Laybuy, MoreTyme, and similar services.

These are external financial providers; all contracts, repayments, and disputes remain between the customer and the finance company.
Fonedash bears no liability for approval outcomes or penalties arising from missed payments.


10. Privacy & Data Protection

Fonedash complies with the Protection of Personal Information Act (POPIA).
All customer data — including names, emails, addresses, and phone numbers — is collected solely for legitimate business use:

  • Order processing and delivery

  • Customer support

  • Marketing (if consented)

We do not sell, rent, or trade your personal information.
Data is stored securely using SSL encryption and accessed only by authorized staff.

You have the right to request correction or deletion of your data at any time by contacting privacy@fonedash.com.


11. Limitation of Liability

To the fullest extent permitted by law, Fonedash (Pty) Ltd, its employees, and partners shall not be held liable for:

  • Indirect or consequential damages

  • Loss of profits or data

  • Courier or transit-related incidents

Our total liability is limited to the purchase price of the product in question.


12. Governing Law

These Terms & Conditions are governed by the laws of the Republic of South Africa.
Any disputes will be resolved in a competent court within South Africa.
